Odunmbaku To Face Legal Action Over Disobedience To Court Order

A chieftain of the All Progressive Congress, APC, James Omolaja Odunmbaku and his associates, are bound to explain their roles on why they jettison an order of a Lagos State High Court, in Ikeja, directing them to maintain the status quo ante, pending determination of the controversy surrounding ownership of a property situated at No. 10, Kudirat Abiola Way, Oregun, Ikeja.
Justice Yhaqub Oshoala had on May 24, this year ordered that parties in a suit number ID/11239LMW/2021 to maintain status quo ante bellum.
The judge gave the order following an interlocutory injuction filed before the court by Mr. Olufemi Fasehun, (For himself as the administrator to the Estate of Late Ebenezer Olawanle Oladipo Fasheun and on behalf of the beneficiaries to the Estate) against James Odunmbaku, Mr. Cletus Nwagwu, Mr. Oluwadare Olanrewaju and others.
The claimant, Mr. Oluremi Fasheun approached the court through his lawyer, Otunba Remi Adeoye of Destiny and Lawlords to seek an order of Interlocutory Injunction restraining the Defendants/Respondents, either by themselves, their servant;, agents and/or privies from breaking in, entering, penetrating, occupying and forcefully taken up possession of the land subject matter of the suit located and situate at No. 10, Kudirat Abiola Way, Oregun, Ikeja, Lagos State measuring approximately 9185.06 square yards delineated in Survey Plan dated 14th October, 1960 prepared by Surveyor Adekunle Kukoyi and registered as No. 6 at page 6 in volume 431 at the Land Registry Office, Ibadan vide Deed of Conveyance dated January, 1961 pending the final determination of this suit.
“An order of Interlocutory Injunction restraining the Defendants/Respondents, either by themselves, their servants, agents and/or privies from trespass on the land subject matter of this suit located and situate at No.10, Kudirat Abiola Way, Oregun, Ikeja, Lagos State measuring approximately 9185.06 square yards delineated in Survey Plan dated 14th October, 1960 prepared by Surveyor Adekunle Kukoyi and registered as No. 6 at page 6 in volume 431 at the Land Registry Office, Ibadan vide Deed of Conveyance dated 10th January, 1961 pending the final determination of this suit.
In support of the application, the claimant, Mr Olufemi Fasehun, filed thirty two (32) paragraphs affidavit deposed to by Adebola Adebukola, a clergyman and an Estate Agent, wherein attached eleven exhibits to prove their claims.
The exhibits attached to prove their claims are Survey Plan as Exhibit, A, Judgment of Supreme Court in Suit No. 31/1952 as Exhibit B, Survey Plan dated October, 1960 as Exhibit C, The title documents of the land as Exhibit D, and Letter of Administration as Exhibit
Others exhibit are; Certified True Copy, Power of Attorney as Exhibit F, Judgment given by Hon. Justice Onyeabo of the High Court of Lagos State delivered in January, 2019 as Exhibit G and others.
Justice Oshoala then issued an order of mandatory interlocutory injunction compelling the defendants to forthwith stop trespassing on the said land pending the final determination of the suit.
Despite the subsisting order, the claimant lawyer, Otunba Remi Adeoye, reported that one of the defendants, James Omolaja Odunmbaku and his cohorts has continually invaded the said land.
Otunba Remi Adeoye who threatened to commence contempt proceedings against James Omolaja Odunmbaku and his associaes, urged members of the public to note that the land at No.10, Kudirat Abiola Way, Oregun, Ikeja, Lagos State which is also accessible through Olayiwola Street, off Kudirat Abiola way, Oregun, Ikeja, Lagos State belong to the Family of Late Ebenezer Olawanle Oladipo Fasehun represented by Mr. Olufemi Fasehun and that Members of the public should be wary in dealing with James Odunmbaku in respect of the said land he was informed by his client that he have it in good authority that James Odunmbaku is working assiduously to sell the said land to unsuspecting buyers and members of the public” he said.
